Terms of Service

Effective July 2, 2026

These terms are an agreement between you and MatGar ("Market Pulse", "we", "us") covering your use of the Market Pulse service at farmersmarketpulse.com. By creating an account or using the service you agree to these terms.

The service

Market Pulse helps market and food businesses record sales, track inventory, plan production, schedule and pay vendors, see profit and loss, and generate order recommendations. Features vary by plan as described on our pricing page.

Your account

You're responsible for keeping your sign-in credentials safe and for activity under your account. Business owners control who joins their business and what role each member gets; owners and admins are responsible for the access they grant. Provide accurate information and keep your email current so we can reach you about your account.

Your data

Everything you enter belongs to you. You grant us only the limited rights needed to host, process, and back up that data so the service can function. You can export your data at any time from Settings → Data & Backups, and you can delete it as described in our Privacy Policy.

Plans, billing, and trials

Refunds

Because you can try every plan free for 14 days and cancel any time, charges already billed are generally non-refundable except where the law requires otherwise. That said, if something went wrong — a billing mistake, a double charge, a service problem — email info@farmersmarketpulse.com and we'll make it right.

Acceptable use

Don't use the service for anything unlawful, don't attempt to break, overload, or probe the service or other users' data, don't resell or white-label the service without our written agreement, and only connect third-party accounts (like Square) that you're authorized to use.

A plain-word disclaimer about recommendations: order suggestions, forecasts, pay and bonus calculations, and P&L figures are computed from the data you put in. They're estimates and tools, not guarantees — what you order, produce, and pay is always your decision. Market Pulse is not accounting, tax, or legal advice.

Service changes and availability

We improve the service continuously; features may change, and features marked beta may change or be withdrawn. We aim for high availability but the service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. Keep backups — the app makes that easy.

Our continuity commitment

Your business shouldn't depend on ours staying online. In the unlikely event we permanently shut down the Market Pulse cloud service, we will provide paid subscribers with an offline version of the app — one that runs without our servers, using your locally stored and exported data — together with reasonable notice and a final data export window, so you can keep running your markets without interruption. (The app is local-first by design: your register, plans, inventory, and P&L already work offline day to day.)

Limitation of liability

To the maximum extent permitted by law, we're not liable for indirect, incidental, special, or consequential damages, or lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.

Termination

You can stop using the service or delete your account at any time. We may suspend or terminate accounts that violate these terms, and where practical we'll notify you first. On termination you can request an export of your data as described in the Privacy Policy.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules.

Changes to these terms

If we make material changes we'll update the date above and notify account owners by email. Continued use of the service after changes take effect means you accept the updated terms.
